These terms and conditions apply between you, the user of this website and the owner and operator of this website, SprinkleInk Ltd. Please read these terms and conditions carefully as they affect your legal rights.

These Terms will be applied fully, by using this website you agree to accept all terms and conditions written here. You must not use this website if you disagree with any of these website Terms and Conditions.

SprinkleInk Ltd reserves the right to change these terms and conditions at any time.

In these terms and conditions, User or Users means you or any third party accessing the Website, The Company, Owner and SprinkleInk refers to SprinkleInk Ltd.

Intellectual Property and Acceptable Use

1. All content included on the Website is the property of SprinkleInk Ltd or their affiliates. In these terms and conditions, contents means any text, graphics, images, video, page layout and any other information capable of being stored in a computer that appears on or forms part of this Website.

2. By using this website, you acknowledge the Content is covered by intellectual property rights including copyright. Nothing on this Website, including The Company logo can be used or copied without the Owner’s written permission first.

3. Users must not copy, reproduce, modify or distribute any Content or Products (refer to The Raksha Box) for commercial purpose without the written permission of the Owner.

Prohibited Use

4.You may not use the Website for the following purposes:

a.in any way which causes damage to the Website or interferes with any other person’s use or enjoyment of The Website;

b.In a way which is harmful, illegal, abusive, harassing, threatening or anything which may be deemed as objectionable by The Company or Governing Law.

Products or Service Provided

5. SprinkleInk Ltd offer the following services;

a. SprinkleInk’s Collection range

b. SprinkleInk’s bespoke range

6. SprinkleInk sell wide range of event stationary and sell products to buy on the Website and on other social media platforms including Instagram and Facebook. Products include The Raksha Box, specifications of this product is listed on the website.

7. Once you have placed an order with SprinkleInk Ltd, you have signified your acceptance to be bound by these terms and conditions.

The Raksha Box

8. The specifications of The Raksha Box (also referred as the Box) is listed on this website. It includes; one traditional rakhi thread, one personalised message, artificial flowers and 6 pieces of Ferro Rocher chocolates.

9. By placing an order, users will have seen the warning and acknowledged the chocolates inside The Raksha Box contain nuts.

10. The design copyright of the Box will always remain with SprinkleInk and must not be resold.

Returns and Complaints

11. Due to the Covid-19 pandemic and to maintain hygiene, SprinkleInk do not accept returns of The Raksha Box unless it is still wrapped in the shrink wrap and has not been opened. If so, the user should contact the Owner within 10 days from when the box was received by User and send the Box back to SprinkleInk within 14 days of reciept. The Company is not liable for return postage costs or responsibilities, it is recommended to send the Box via recorded delivery. If the return is accepted by the Owner, they will refund the user within 5 working day from the date of their confirmation email.

12. If there is a noticeable default in the Box the user should contact the Company to replace the Box. SprinkleInk will only accept a return and refund the owner in full if the rakhi is damaged upon receipt of the Box, this does not include damage to the bead work of the rakhi.

13. The Company does not accept returns and refund of the Box if there is slight damage to the box itself, the flowers or the chocolates. If there is significant damage to these, the User should contact the Company who hold the discretion to refund or replace the Box. This should be done within 10 days upon receipt of the Box.

14. The Company does not provide warranty for any part or any of the items in The Raksha Box.

15. Any complaints in relation to the box or the order process should be communicated to the Company on orders@sprinkleink.co.uk. The User should start the complaints process within 14 days upon receipt. SprinkleInk will investigate and reply to the complaint within 3-5 days of the User’s email.

16. Ultimately, SprinkleInk hold the discretion to refund Users if deemed suitable following their investigation into the matter.

17. Any refund will be made into the same account that payment was made through. This will be done via PayPal, please refer to the terms and conditions of Prices and Payments.

Prices and Payment

18. All prices displaced on the Website, social media pages and invoices and non-negotiable.

19. The Company may offer discount codes for users, this can only be used once per transaction. SprinkleInk reserve the right to withdraw any discounts and offers of The Raksha Box.

20. The price listed by SprinkleInk are in Great British Pounds Sterling. For order made outside of the United Kingdom, prices listed will exchange to the relevant currency depending on the exchange rate at that particular time. This will be done through PayPal.

21. Payments are made through PayPal, users will not need to have a PayPal account to make the payment. PayPal will provide an option to make this payment through credit cards.

22. By completing the purchase, User will have acknowledged any terms and conditions set by PayPal.

23. If User is experiencing trouble making a payment through PayPal, they should contact the Company whom may allow the User to make a payment through a bank transfer.

24. Once any payment has been received from the User, it is taken as confirmation that they have read and agreed to all terms and conditions listed on here.

25. The Raksha Box remains the property of SprinkleInk until it is paid for in full by the User. All the Design and Intellectual property of the Box will always remain the property of SprinkleInk.

26. Any price increase by the Company will not affect any confirmed orders.

Delivery, Postage and Packing

27. Once full payment has been received by SprinkleInk, User will receive a confirmation email, followed by an email confirming the Box has been dispatched.

28. The Raksha box will be dispatched within 2 days of order confirmation. It will be shipped via Hermes (Tracked) delivery service. It should be noted that the Company may not receive proof of User’s signature from Hermes due to the Covid-19 pandemic and therefore in such circumstances SprinkleInk will consider receipt of delivery by Hermes as full proof of receipt.

29. The Raksha Box will be delivered within 2-4 days from the dispatch date, but Owner is not accountable for any delays from Hermes or by Acts of God.

30. SprinkleInk strive to meet all delivery deadlines. However, all agreed delivery dates are approximate, and the Company cannot be held responsible or accountable as a result of failure to deliver on any set date.

31. The User must clearly state which address they prefer to receive the delivery; the Company will hold no liability where the User enters an erroneous address.

32. SprinkleInk accept no liability for goods lost in transit. As soon as the Company has dispatched The Raksha Box, complete responsibility is handed from SprinkleInk to the User. If the Box does not arrive as scheduled, it is the User’s responsibility to pursue the Box in transit. The User will be informed of the tracking number from the Company in writing when the order has been dispatched.

33. The Raksha box will be wrapped in shrink wrap and highly maintained in consideration of health and safety.

34. SprinkleInk is not liable for any consequential lossHer

Limitation of Liability

35. Except in respect of death or personal injury caused by our negligence, SprinkleInk will not be liable to the User, for any losses arising out of events beyond our reasonable control or any indirect special or consequential loss, damage, costs, expenses or other claims, which arise out of, or in connection with, the supply of goods other than as a result of a breach of an obligation arising under the Sale of Goods Act 1979 (as amended) and the Supply of Goods and Services Act 1973.

General

36. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

37. These terms and conditions may be varied by the Company from time to time. Such revised terms will apply to the Website from the date of publications. Users should review these terms and conditions before making any orders.

38. The Agreement shall be governed by and interpreted in accordance to the law of England and Wales. All disputes that may arise shall be subject to the exclusive jurisdiction of the English courts.

39. The headings in this agreement are for the convenience of the user and will not affect their interpretation.

40. Any terms and conditions that are not adhered to can arise in legal claims.
